Points to Ponder
WHY? The firing of town manager La Ron Garrett triggered an effort to recall Mayor Tom Morrissey and council members Ferris, Sterner, and Tubbs-Avakian. This recall attempt cost somebody a huge amount of money. The actual cost of these efforts and the identity of the individuals responsible should be revealed when the campaign finance report is filed in mid January. Thousands of dollars ( possibly $100,000 or more) spent to remove the Mayor and others only a few months ahead of an election. WHY ??
Shortly after the Arizona State Supreme Court decision blocking the recall effort against the Mayor was announced, the MHA Foundation and the RCEF file documents threatening a lawsuit against the Town of Payson for an unbelievable amount of money ($87.4M x 2 )9 because of comments made by Mayor Morrissey and councilman Ferris about the MHA Foundation. A serious review of the details within the “Notice of Claim” and the history of the individual companies listed, might reveal to the public the MHA Foundation’s actual intentions for the “University” property.
EDUCATION?? Is this threatened lawsuit an effort to stifle any criticism of past and present activities of the MHA Foundation?? I am sure the people who live on Mud Springs Road across from the property recently cleared to construct “ball fields” might have something to say about that. They will be living with the results of that work for years to come. Things like reduced property value, traffic problems, light pollution, and noise every summer night. Resolution 36 enacted by the RCEA-SLE in May of this year declares that they don’t have to follow any of the town planning and zoning rules. The results of not following the rules created many very angry property owners and possibly a huge expense to the Town to mitigate traffic and infrastructure problems. Asking questions about proposed projects within the town of Payson is the job of the Mayor and Councilman Ferris and they should continue to do so.11
The cost for the Town to defend against this threatened lawsuit would be tremendous, but maybe it is time to have this confrontation. Court costs can be recovered when prevailing against frivolous lawsuits. The answer to the question “WHY?” might come when the principal players from the MHA Foundation, the RCEF, and the RCEA-SLE are deposed and questioned under oath which is exactly what will happen if their lawsuit is filed. Is this a real lawsuit or just an attempt to intimidate those who question prior administration policy? It is time to find out.
