Attorney General Eric Schmitt, of the Great State of Missouri, receives a number of legal briefs and requests on a daily basis. However this past July, he received a disturbing notice, from several county sheriffs.
What has the Missouri Attorney General in a huff? His department was being informed, via the county sheriffs, that the FBI will be showing up to “audit” the Concealed Carry Weapons (CCW) Permit holder records. The FBI states, “The audit includes onsite review of your CCW Permits.”
Mr. Eric Schmitt, Attorney General exclaimed ‘allowing federal agents from the FBI to have access to records of Missourians who have a permit to carry a concealed weapon, violates Missouri law and infringes upon our second amendment rights. Furthermore, Missouri law specifically prohibits sharing this confidential list with the federal government under subsection 571.101.9(2) ‘shall not be distributed to any federal, state, or private entities’ This law was passed to leave no doubt that the citizens of Missouri have a constitutional right to bear arms, and the federal government has no business poking around to find out their identities.
Mr. Eric Schmitt went on to state, the law was deliberately written so that only the elected sheriff has access to CCW listings. Mr. Schmitt continued excoriating the US Attorney General, Merrick Garland, for his forgetfulness of who upholds the second amendment, i.e. the Supreme Court. He reminded him of recent landmark opinions in New York State Rifle & Pistol Association.
Mr. Eric Schmitt made it very clear to US Attorney General Merrick Garland… The 2nd Amendment does not apply to CCW’s, semi-auto rifles, nor does it apply to bolt action rifles, pistols or revolvers. The 2nd Amendment RESTRICTS GOVERNMENT. The technology of the firearm is irrelevant. The restrictions on government remain the same, regardless of the firearm or permit. The 2nd Amendment was not written to grant permission for citizens to own and bear arms firearms. It forbids government interference in the right to keep and bear arms, period. The right of the people to keep and bear arms, shall not be infringed.
As a reminder US Attorney Merrick Garland… The above applies to the other ‘Rights’. They are not granted, they stipulate inherent rights that the government may not prohibit, period!
